Dr. Paul Moses Ogidi, the African Democratic Congress (ADC) candidate in the recent FCT Area Council election, has demanded the immediate suspension of the proposed judgment in Petition No. FCT/ACET/EP/01/2026, citing serious jurisdictional flaws in the composition of the Area Council Election Petition Tribunal. Ogidi argues that the tribunal was formed in violation of Section 135(3) of the Electoral Act, 2026, which mandates the inclusion of a High Court judge among its members. He insists that without such a judge, the tribunal lacks the legal authority to hear or determine the case, raising fundamental questions about the legitimacy of any judgment it may deliver.
In a statement released on Tuesday, Ogidi revealed that his legal team had formally petitioned the Chief Judge of the Federal Capital Territory on April 10, 2026, seeking the reconstitution of the tribunal in accordance with the law. When no response was received, a second petition was submitted to the Chief Justice of Nigeria on May 21, 2026, urging urgent intervention. Despite these efforts, Ogidi stated that the tribunal has proceeded with its proceedings and plans to deliver judgment, even as the core legal issue remains unresolved.
He emphasized that jurisdiction is the bedrock of any judicial process, quoting legal principles that a tribunal without proper jurisdiction cannot validate its proceedings through mere passage of time. Ogidi warned that proceeding with judgment under these circumstances could lead to serious legal and constitutional challenges, potentially undermining the credibility of the electoral justice system. He stressed that the issue is not merely personal but affects the broader integrity of Nigeria’s electoral framework.
To ensure transparency and accountability, Ogidi disclosed that his team has also sent communications to several international bodies, including the United Nations, the European Union, the United States Embassy, and the British High Commission. He called on the Chief Justice of Nigeria to step in immediately and ensure the tribunal is reconstituted as required by law.
