Man Sentenced to Prison for Stabbing Neighbor in Domestic Incident

A 32-year-old man, Israel Friday, has been remanded in custody by an Abuja High Court over allegations of stabbing his neighbour, Theophilus Edache, during a dispute in Angwan Tiv, Zone 7, Lugbe. The court, presided over by Justice M. S. Idris, made the order on Wednesday after the prosecution raised concerns about the defendant’s potential threat to the victim. Friday is facing charges of attempted culpable homicide under sections 229(1) and 248 of the Penal Code Law. The incident reportedly left Edache with a grievous injury, resulting in the amputation of his left hand.

The prosecution, led by Donatus Abah, argued that Friday’s actions were severe and posed a continued danger to the victim. Abah emphasized that Edache, once able to defend himself with both hands, is now physically vulnerable due to the amputation. He submitted a counter-affidavit opposing the bail application and presented the amputated arm as evidence of the severity of the injury. Abah warned the court that releasing Friday on bail could lead to further violence, possibly resulting in the victim’s death.

In response, Friday’s counsel, Noah Abdul, urged the court to grant bail on liberal terms. He pointed out that the offence is not capital and therefore should not preclude the possibility of bail. Abdul stressed that his client had pleaded not guilty and should be afforded the right to a fair trial while out of custody. He requested that the court consider the principles of justice and proportionality in making its decision.

Justice Idris, after hearing submissions from both sides, adjourned the case until May 13 to deliberate on the bail application and to proceed with the trial. The court’s decision to remand Friday in custody reflects concerns over public safety and the victim’s well-being. The case has drawn attention due to the physical consequences suffered by Edache and the potential for further harm if the accused is released.

This incident highlights the ongoing challenges related to violence and conflict resolution in urban communities across Nigeria. The court’s handling of the case will be closely watched, especially as it involves serious bodily harm and questions about the balance between justice and public safety. The outcome may set a precedent for similar cases involving violent crimes and bail applications in the Federal Capital Territory.
